VISIT VIETNAM PLATFORM TERMS OF USE

Applicable to Customers/Users who download, install, access, register for, and use the Visit Vietnam mobile application and website

I. GENERAL PROVISIONS

1. Scope of Application

These Terms of Use of the Visit Vietnam application and website (the "Terms") apply to all customers and users who download, install, open, access, register an account, log in to, browse, interact with, or otherwise use any content, features, utilities, products, services, or functionalities available through the Visit Vietnam application, website, digital platform, or any other online channels operated under the Visit Vietnam brand (collectively, the "Platform").

Visit Vietnam is a digital tourism platform designed to assist users in discovering, accessing, and engaging with information relating to tourism destinations, attractions, tourism services, merchants, promotional offers, digital utilities, and other content associated with travel experiences in Vietnam.

The Platform currently provides, and may from time to time introduce, functionalities including but not limited to service booking, voucher issuance and redemption, online payment processing, electronic transactions, digital check-in, QR code services, interactive maps, itinerary recommendations, and other features subject to product development roadmaps, technical capabilities, and announcements made by Visit Vietnam.

These Terms constitute the general terms governing access to and use of the Platform. Where a user engages in a specific transaction, including but not limited to booking services, making payments, redeeming vouchers or promotional codes, or purchasing products or services, the user shall be required to review and accept any additional terms and conditions applicable to such products, services, merchants, payment arrangements, cancellation policies, refund policies, exchange policies, and other transaction-specific notices published at the relevant time.

By downloading, installing, opening, accessing, registering an account on, or continuing to use the Platform, the user acknowledges that he/she has read, understood, and agreed to be bound by these Terms, the Visit Vietnam Personal Data Protection Notice, and any additional policies or conditions published from time to time.

If the user does not agree with any part of these Terms, the user must immediately discontinue access to and use of the Platform and its associated services.

2. Compliance Framework and Governing Principles

These Terms are established in accordance with the principles of transparency, consumer protection, electronic transaction security, personal data protection, intellectual property protection, and compliance with the applicable laws and regulations of the Socialist Republic of Vietnam.

Relevant legal references include, among others:

  • Law on Protection of Consumer Rights 2023
  • Law on Electronic Transactions 2023
  • Law on Personal Data Protection 2025
  • Law on Cyber Information Security
  • Law on Intellectual Property
  • Law on Tourism
  • Law on Advertising
  • Decree No. 52/2013/ND-CP on E-Commerce, as amended by Decree No. 85/2021/ND-CP
  • Decree No. 81/2018/ND-CP on Trade Promotion; and
  • Other applicable laws, regulations, and governmental guidance in force from time to time

In the event that any applicable law is amended, supplemented, replaced, or repealed, the legal provisions effective at the relevant time shall prevail.

Where there is any inconsistency between these Terms and any specific terms, policies, notices, or conditions applicable to a particular product, service, feature, promotion, or transaction, such specific terms shall prevail solely with respect to the relevant subject matter, provided that such terms do not conflict with mandatory provisions of applicable law.

3. Definitions

For purposes of these Terms, the following terms shall have the meanings set forth below:

3.1 "Visit Vietnam", "we", "our", or "us"

means the operator of the Visit Vietnam Platform, including Vietnam Tourism Data Company Limited and/or its authorized affiliates, contractors, partners, service providers, and other entities engaged in the lawful operation, administration, support, and management of the Platform.

3.2 "Customer" or "User"

means any individual or legal entity that downloads, installs, accesses, registers for, interacts with, or uses any content, features, products, services, or functionalities available through the Platform.

3.3 "Platform"

means the Visit Vietnam mobile application, website, online portal, user account system, notification channels, and any other digital products or services operated under the Visit Vietnam brand.

3.4 "Merchant", "Service Partner", or "Service Provider"

means any business entity, organization, household business, or individual that offers, promotes, facilitates, supports, or provides products, services, destinations, experiences, promotions, or related information through the Platform.

3.5 "Account"

means a user account established on the Platform through a mobile phone number, email address, social media account, electronic identity credential, or any other registration or authentication method accepted by Visit Vietnam.

3.6 "Content"

means any text, image, video, audio, map, data, article, review, rating, comment, merchant information, destination information, itinerary recommendation, promotional material, or other information displayed on the Platform.

3.7 "Features" or "Utilities"

means any user-support functionality made available through the Platform, including search tools, saved locations, maps, itinerary planning tools, QR code scanning, check-in functionality, promotional benefits, notifications, account management tools, interaction history, and other features introduced by Visit Vietnam from time to time.

3.8 "Personal Data"

shall have the meaning prescribed under applicable Vietnamese laws on personal data protection and includes basic personal data, sensitive personal data, and any information capable of identifying or relating to a specific individual.

3.9 "Specific Terms"

means any separate terms, conditions, policies, notices, guidelines, or instructions applicable to a specific product, service, feature, promotional campaign, voucher program, booking service, payment arrangement, or transaction available on the Platform.

3.10 "Transaction"

means any booking, reservation, purchase, payment, voucher redemption, service request, cancellation request, refund request, exchange request, or other activity capable of creating rights and obligations among the User, Visit Vietnam, Merchants, Service Partners, entities within the Sun Group ecosystem, or other relevant third parties.

3.11 "Booking"

means a request submitted by a User to purchase, reserve, confirm, hold, or use a product or service displayed through the Platform.

3.12 "Payment"

means the fulfillment of a User's payment obligation through a bank account, payment card, electronic wallet, QR code, bank transfer, payment gateway, intermediary payment service provider, or any other payment method supported by the Platform.

3.13 "Transaction Confirmation"

means any booking confirmation, electronic ticket, electronic voucher, QR code, email confirmation, SMS notification, in-app notification, electronic record, or other digital evidence confirming the existence or status of a transaction.

3.14 "Payment Institution"

means any licensed bank, card issuer, electronic wallet provider, payment gateway operator, payment intermediary service provider, or other organization authorized to process payment transactions under applicable laws.

3.15 "Electronic Consent"

means the User's explicit agreement expressed through a checkbox, confirmation button, one-time password (OTP), electronic signature, booking action, payment action, account authentication, or any other electronic method capable of evidencing the User's informed consent to a relevant policy, notice, term, or condition.

II. USER ACCOUNTS, ACCEPTANCE OF TERMS, AND PLATFORM USAGE RULES

1. Publication and Acceptance of the Terms

Where Users download the Application from the Apple App Store, Google Play Store, or any third-party application marketplace, the download and use of the Application may also be subject to the terms and conditions of the relevant application marketplace.

Visit Vietnam shall make these Terms and the Personal Data Protection Notice available through links on the application marketplace, website, landing pages, or other official communication channels to the extent reasonably practicable.

Upon first launch of the Application, account registration, login, or use of certain key functionalities, Users may be required to acknowledge that they have read, understood, and agreed to these Terms and the Personal Data Protection Notice.

Such acknowledgement may be obtained through one or more electronic methods, including but not limited to checkboxes, confirmation buttons, OTP verification, account authentication, continued use of the Platform, or any other electronic mechanism capable of evidencing consent.

Visit Vietnam may retain records of the User's acceptance, including the time of acceptance, version of the Terms, version of the Personal Data Protection Notice, account details, device information, IP address, application version, and other technical information reasonably necessary to demonstrate consent, protect user rights, maintain system security, resolve disputes, and comply with applicable laws.

2. User Accounts

Certain features of the Platform may require Users to create an Account.

By registering an Account, Users represent and warrant that all information provided is true, accurate, complete, current, and not misleading.

Users must be at least eighteen (18) years of age to register an Account and independently use the Platform.

Individuals between fifteen (15) and eighteen (18) years of age may only use the Platform with the consent and supervision of their parent or legal guardian, who shall be fully responsible for all activities conducted through the Account.

Individuals under fifteen (15) years of age are not permitted to register an Account or conduct Transactions through the Platform.

Visit Vietnam reserves the right to request age verification and to suspend, restrict, or terminate any Account where the applicable age requirements are not satisfied.

Users are solely responsible for maintaining the confidentiality of their Account credentials, passwords, OTPs, authentication codes, devices, and related security information.

All activities conducted through a User's Account shall be deemed to have been performed or authorized by the User unless the User demonstrates unauthorized access and promptly notifies Visit Vietnam.

Users shall not:

  • Sell, transfer, rent, or otherwise permit third parties to use their Accounts
  • Use another person's Account without authorization
  • Create multiple Accounts for fraudulent purposes
  • Abuse promotional programs

Interfere with the operation of the Platform; or

Engage in activities that violate these Terms.

Visit Vietnam may suspend, restrict, verify, or terminate Accounts where reasonable grounds exist to believe that an Account presents security, fraud, compliance, or operational risks.

3. User Rights and Obligations

User Rights

Users are entitled to:

  • Access and use the Platform in accordance with these Terms
  • Access information, content, features, promotions, and services made available through the Platform
  • Submit support requests, feedback, complaints, and inquiries through official support channels

Exercise rights relating to Personal Data as provided under applicable law and the Personal Data Protection Notice; and

Enjoy any other rights provided under applicable laws.

User Obligations

Users shall:

  • Comply with these Terms, the Personal Data Protection Notice, and all applicable policies
  • Provide accurate and lawful information
  • Refrain from impersonating any person or entity
  • Not use another person's information without authorization
  • Protect Account credentials and authentication information

Promptly notify Visit Vietnam of any suspected unauthorized access or security incident; and

Be solely responsible for any content, reviews, comments, images, or information uploaded, submitted, or shared through the Platform.

4. Rights and Responsibilities of Visit Vietnam

Visit Vietnam reserves the right to operate, manage, maintain, modify, improve, suspend, discontinue, or replace any part of the Platform at any time to support product development, operational requirements, technical needs, security measures, legal compliance, and business objectives.

Visit Vietnam may review, edit, restrict, remove, reject, or disable any content, feature, or Account where there is a reasonable belief that such content or activity violates these Terms, infringes third-party rights, creates security risks, constitutes fraud, or otherwise adversely affects the Platform.

Visit Vietnam shall make reasonable efforts to maintain Platform availability, safeguard user information, provide support channels, and cooperate with merchants, partners, and competent authorities where required by law.

5. Platform Usage Rules

Users shall not:

  • Use the Platform for unlawful purposes
  • Violate the rights or legitimate interests of Visit Vietnam, Merchants, Service Partners, other Users, or third parties
  • Access or attempt to access systems without authorization
  • Circumvent security measures
  • Conduct vulnerability scanning, penetration testing, or exploit system weaknesses without authorization
  • Use bots, crawlers, scrapers, automated tools, or similar technologies in violation of applicable policies
  • Create fake accounts
  • Misrepresent identities or affiliations
  • Upload or distribute unlawful, defamatory, misleading, offensive, obscene, infringing, or otherwise inappropriate content
  • Violate intellectual property rights, privacy rights, or personal data protection laws
  • Copy, reproduce, distribute, commercialize, reverse engineer, extract, or create derivative works from Platform content without authorization
  • Engage in any conduct reasonably deemed harmful to the Platform, its users, partners, or operations

III. INFORMATION, CONTENT, FEATURES, TRANSACTIONS, AND PERSONAL DATA

1. Information, Content, and Services

The Platform may display destinations, attractions, events, tourism experiences, travel products and services, merchant information, reviews, recommendations, maps, articles, promotional campaigns, and other tourism-related content.

The inclusion, recommendation, classification, or display of any Merchant, destination, service provider, or product on the Platform does not constitute a guarantee, endorsement, warranty, or representation regarding quality, safety, availability, pricing, legality, or suitability.

Users remain responsible for independently evaluating and verifying information before making purchasing decisions or using services.

2. Check-in, QR Code, Voucher, and Promotional Features

Users who utilize check-in features, QR code services, location-based functions, digital vouchers, promotional benefits, rewards programs, or other Platform utilities must comply with all applicable usage conditions and eligibility requirements.

Visit Vietnam may process relevant account information, device information, location data, QR code data, voucher information, and technical records necessary to authenticate usage, prevent fraud, administer promotions, improve services, and maintain system security.

Visit Vietnam reserves the right to reject, revoke, cancel, suspend, or invalidate benefits, vouchers, rewards, or promotional entitlements where there is evidence of fraud, abuse, misuse, manipulation, false information, unauthorized transfers, or violations of these Terms.

3. Booking, Transactions, Payments, and Transaction Confirmation

Visit Vietnam may facilitate bookings, reservations, ticket purchases, hotel reservations, voucher purchases, online payments, and other electronic transactions.

Prior to confirming a booking or payment, the Platform may provide information including:

  • Product or service descriptions
  • Merchant information
  • Usage locations
  • Dates and times
  • Number of guests
  • Pricing, taxes, fees, and surcharges
  • Payment methods
  • Refund and cancellation conditions
  • Voucher and QR code conditions
  • Merchant policies
  • Other applicable transaction terms

By selecting "Book", "Confirm", "Pay", "Book and Pay", or any equivalent action, Users acknowledge that they have reviewed and accepted the transaction information displayed.

Users may also be required to separately confirm acceptance of specific booking conditions, refund policies, cancellation policies, no-show policies, merchant terms, and other transaction-specific requirements.

Transaction confirmations may be issued in the form of booking references, e-tickets, e-vouchers, QR codes, confirmation emails, SMS messages, in-app notifications, or other electronic records.

Visit Vietnam may retain transaction logs, payment records, consent records, device information, IP addresses, application versions, authentication records, and other technical evidence necessary for fraud prevention, dispute resolution, reconciliation, compliance, and legal enforcement purposes.
